4. Information We Collect About Research Subjects
If you are a Research Subject, this section describes what information Vijilent may collect and store about you.
Vijilent does not collect information about Research Subjects directly from them, and Research Subjects do not have a business relationship with Vijilent. Information is collected from the sources described in Section 5, at the request of a Customer or Visitor, in connection with specific legal matters.
Depending on what is available from public and third-party sources, information about a Research Subject may include:
- name, and identifiers such as approximate age, date of birth, or address, as supplied by the Customer or obtained from public sources;
- current and prior addresses and associated location information;
- publicly available social media accounts, profiles, posts, comments, photographs, group memberships, and similar publicly visible content;
- publicly available court records, including civil and criminal case records;

- assessments, summaries, and ratings that Vijilent generates from the above (see Section 7).
Vijilent does not access private, restricted, or password-protected information, nor does not engage in the use of deception, pretext, or false identity to obtain information; and does not contact Research Subjects. Vijilent's Terms of Service prohibit Customers from contacting Research Subjects or taking action likely to make a Research Subject aware they have been researched.
Vijilent does not reuse information about a Research Subject across Cases. Research is performed fresh for each Case, and Vijilent does not maintain a persistent profile or standing file on any Research Subject.
Vijilent is not a consumer reporting agency as defined by the Fair Credit Reporting Act, and the information it provides is not a consumer report. Vijilent's Terms of Service prohibit Customers from using information obtained through the use of Vijilent’s Services for credit, insurance, employment, housing, educational, licensing, or other FCRA-covered eligibility purposes.

5. Sources of Information
Vijilent obtains information about Research Subjects from:
Public records aggregators—commercial services that compile records from government and public sources, including address history, property records, professional licenses, and motor vehicle registration records.
Social media and other publicly accessible online sources—content that the individual or a third party has made publicly visible.
Federal, State, County, City, and other court or administrative public records—obtained directly on occasion.
Information supplied by the Customer—identifying details provided to initiate the research.
Vijilent does not control or warrant the accuracy or completeness of information held by these sources. Information originating with a third-party source generally cannot be corrected by Vijilent at that source.

- maintain business, tax, and accounting records.
We do not sell personal information for money.
We do not use personal information for advertising or marketing to Research Subjects, and we do not use Research Subject information to build profiles for any purpose other than the Case for which it was collected.

7. Automated Analysis and Ratings
Reports may include assessments or ratings generated with the assistance of automated tools, including artificial intelligence, applied to the material collected and to criteria the Customer supplies.
These assessments are informational aids to a Customer's professional judgment. Vijilent does not make any decision about any Research Subject. All decisions in jury selection are made by the Customer, who is contractually responsible for exercising independent professional judgment and for verifying information before relying on it.
Automated assessments may be inaccurate. Individuals share names. Public records contain errors. Social media accounts may be misattributed, abandoned, satirical, pseudonymous, or operated by someone other than the named individual.
Research Subjects who wish to have information removed may make a request under Section 11.
8. How We Share Information
We share personal information only as follows:
Service providers and subcontractors. We share information with our service providers, subcontractors, and vendors that host our systems, provide public records and data services, process payments, and generally support our business operations. These parties are bound by confidentiality obligations and are only permitted to use the information only to provide services to Vijilent.
Verification partners. In connection with research services, we share personal information with certain third-party companies for the sole purpose of verifying information about a Research Subject. These companies are subject to confidentiality obligations and are not permitted to store, save, or transfer the information other than as necessary to perform their services to us. We do not share Research Subject information with these companies for any other purpose.
The requesting Customer. Reports and research results are delivered to the Customer that requested them by us and we provide these Reports and research findings to no one else. Customers are contractually restricted from redistributing them except to co-counsel, retained consultants, the court, or others as required in the matter.
Legal process and compliance. We may share personal information in response to a subpoena, court order, or other legal process, or where otherwise required by law. Where we are legally permitted to do so, we notify the affected Customer.
Protection of rights and safety. Where we believe disclosure is necessary to enforce our agreements, to protect the rights, property, or safety of Vijilent or others, or to investigate fraud or unlawful use of the Site.
Business transfers. We may share personal information connection with a merger, acquisition, financing, reorganization, sale of assets, or similar transaction, or during due diligence for such a transaction, personal information may be transferred to the acquiring or successor entity. Any successor will remain bound by the commitments in this Policy with respect to information transferred, including the retention limits in Section 10 and the removal process in Section 11, until it provides notice of a change consistent with Section 15. Where the transaction involves due diligence review, we require the recipient to be bound by confidentiality obligations and to limit access to what is reasonably necessary.
Motor vehicle records. Records obtained from motor vehicle sources are subject to additional restrictions described in Section 14.
9. Cookies, Analytics, and Tracking
Cookies we use. The Application and Site use cookies that are necessary for it to function, maintaining your signed-in session and remembering your search options and case table display preferences. The Site uses cookies set by our website platform for site functionality and analytics.
Analytics. We use Google Analytics and the analytics built into our website platform to understand how the Site is used. These tools collect IP address, device and browser information, pages viewed, and similar usage data.
No advertising. We do not display advertising, nor do we use advertising cookies, and we do not permit third parties to track Customers, Visitors, or Research Subjects across other websites through our Site.
No cookies or tracking are used in connection with Research Subjects. The information Vijilent collects about Research Subjects comes solely from the sources in Section 5.
10. Data Retention and Deletion
Case Data. Vijilent retains all data associated with a Case, including information about Research Subjects, research materials, and Reports for twelve (12) months following the date of last activity on that Case, after which it is permanently deleted. Vijilent will attempt to notify the Customer approximately 30 days and again approximately 7 days before deletion of these materials so that the Customer may export anything it wishes to keep.
Data a Customer exports before deletion is thereafter in the Customer's custody and control and is subject to the Customer's own retention practices, not Vijilent's.
Court-generated juror lists are not retained beyond the time required to transcribe their contents into the Application.
Backups. Deletion extends to our backup systems. Because backups operate on a rolling cycle, data may persist in backup media for up to 35 days after deletion from active systems, during which it remains protected as described in Section 12 and is not accessible to us in the ordinary course.
Legal holds. We suspend deletion where data is subject to a subpoena, preservation demand, litigation hold, or other legal obligation to preserve, for as long as that obligation continues.
Account and business records. We retain Customer account records, quotations, invoices, and records of acceptance of our Terms and this Policy for as long as the account is active and thereafter for the periods required for tax, accounting, and legal purposes. These records do not identify Research Subjects.
Disclosure records for motor vehicle information. See Section 14.
11. Research Subject and Customer Data Requests
If you are a Research Subject or Customer and want Vijilent to delete information it holds about you, you may request removal at no cost.
How to request. Send a request to privacy@vijilent.com. Include your full name and enough identifying information, such as current address, and approximate date of birth, for us to locate records that pertain to you and distinguish you from others with the same name. Provide an email address so we can respond.
Verification. We ask for identifying information solely to confirm that records we locate relate to you, and to avoid deleting or disclosing another person's information. We use information submitted for a removal request only to process and respond to that request. We do not sell, share, or otherwise use information disclosed in a data or deletion request for any other purpose. We delete verification information after the request is resolved, except as needed to record that the request was made and handled.
What we do. Upon verifying a request, we provide you with the personal information we are in possession of, correct you personal information, or delete information pertaining to you from our production systems, depending on the nature of the request, including any reports generated from it, and from our backups on the cycle described in Section 10. We will confirm to you in writing when the deletion is complete.
Timing. We will confirm our receipt of your request within 10 business days and respond to requests within 45 days. If we need additional time, up to 45 days, we will tell you within that period and explain why.
What we cannot do. Vijilent does not control the third-party sources described in Section 5. Deleting our records does not remove information from public records, social media platforms, court records, commercial data sources, or any other source other than our own databases/records, and does not prevent those sources from being consulted in the future in connection with a different matter, whether by Vijilent or by anyone else. To have information removed at the source, you must contact that source directly.
Limits. We may decline or limit a request where we are legally required to retain necessary information, including under a legal hold or under Section 14, or where we cannot verify that the records relate to you. If we decline your data request, we will explain why such request was denied.
Retaliation. We will not treat you differently or penalize you for making a data request.
12. Security
Vijilent maintains a written information security program with commercially reasonable administrative, technical, and physical safeguards designed to protect personal information against unauthorized access, use, disclosure, alteration, and destruction, appropriate to the sensitivity of the information and consistent with applicable law, including the Massachusetts data security regulations at 201 CMR 17.00.
These safeguards include access controls limiting access to personnel who need it, encryption of data in transit and at rest, confidentiality obligations for personnel and subcontractors, and monitoring and logging of access to our systems.
If we become aware of a security incident involving unauthorized acquisition of or access to personal information, we will notify affected individuals and entities as required by applicable law and without unreasonable delay.
No security program can guarantee absolute security, and we cannot warrant that information transmitted to us over the internet will be secure in transit.
13. Your Privacy Rights
Residents of certain states have rights regarding personal information under state privacy laws. Depending on where you live, these may include the right to know what personal information we hold about you and how we use and share it; the right to obtain a copy of it; the right to correct inaccuracies; the right to request deletion; the right to opt out of sale, sharing, or targeted advertising; the right to limit use of sensitive personal information; and the right not to be discriminated against for exercising these rights.
To exercise any of these rights, contact us at privacy@vijilent.com. If you are a Research Subject or Customer seeking deletion, Section 11 describes the process.
Authorized agents. You may designate an agent to make a request on your behalf. We will require proof of the agent's authority and may ask you to verify your identity directly.
Appeals. If we decline your request, you may appeal by replying to our response or writing to privacy@vijilent.com with the word "Appeal" in the subject line. We will respond to an appeal within 45 days.
14. Motor Vehicle Records
Some information Vijilent obtains from public records aggregators originates in state motor vehicle records and is subject to the federal Driver's Privacy Protection Act, 18 U.S.C. § 2721 et seq. ("DPPA").
Vijilent obtains and discloses such information only for purposes permitted by DPPA, specifically use in connection with a civil, criminal, administrative, or arbitral proceeding, including investigation in anticipation of litigation, as provided at 18 U.S.C. § 2721(b)(4). Customers represent, as a material condition of using our services, that their use falls within a permitted purpose.
As required by 18 U.S.C. § 2721(c), Vijilent maintains records identifying each entity that receives information derived from motor vehicle records and the permitted purpose for which it is used, for five (5) years, and makes those records available to the applicable state motor vehicle department on request. These disclosure records are retained separately from Case Data and survive the deletion described in Section 10. They identify the receiving Customer, the Case, and the permitted purpose.
15. Changes to This Policy
We may update this Policy from time to time. We will assign a new effective date, post the current version our Site, and make it available in the Application.
For material changes affecting Customers, we will give notice and, consistent with our Terms of Service, require acceptance before continued use of the Application. For material changes affecting Research Subjects.

The Application and Site are not directed for use by children. We do not knowingly permit anyone under 18 to create an account or use the Application. If you are under the age of 18 years old, you are not permitted to use the Application, the Sile, or utilize our services.
Our Terms of Service prohibit Customers from requesting research on any individual known or believed to be under 18.
